Is Bingo Legal in California? Charity Rules and Online Play
California permits qualifying charitable bingo under local authorization and the conditions in Penal Code §326.5. Players must attend the authorized game location. Online products require a separate review: California now prohibits the dual-currency online sweepstakes games defined in Penal Code §337o, which expressly includes bingo among the simulated gambling games it covers. Both provisions appear in the California Gambling Control Commission’s October 1, 2026 law book.
Local authorization for charitable bingo
Section titled “Local authorization for charitable bingo”Penal Code §326.5(a) provides an exception for bingo conducted under a city, county, or city-and-county ordinance. It covers specified tax-exempt organizations, mobilehome park associations, senior citizens organizations, and charitable organizations affiliated with a school district. The games and use of their receipts must meet the section’s conditions.
Check the ordinance and applicable bingo license with the jurisdiction where the event takes place. California’s Department of Justice directs charitable bingo inquiries to the local city or county. Registering a different kind of nonprofit gambling fundraiser does not answer the license question for a bingo event.
Attendance, staffing, and use of proceeds
Section titled “Attendance, staffing, and use of proceeds”Penal Code §326.5 in the current official law book sets the following conditions:
- Games on property used by the organization for its office or exempt purposes, with the required property rights.
- Games open to the public, with players physically present and no minors participating.
- Operation by members of the authorized organization, subject to the limits on compensation.
- Bingo funds kept separate from other money and used as the law requires for charitable purposes.
- The applicable city or county license and compliance with local rules.
The statute treats profits for §23701d tax-exempt organizations and proceeds for other eligible organizations differently. Its permitted expenses also have conditions. Read §326.5 in the current law book when reviewing an organization’s finances; a donation of part of the receipts does not establish compliance with every requirement.
Section 326.5(m) requires physical presence at the time and place of the game. The physical-attendance requirement matters even when a game uses equipment to help players follow the calls. A local charitable bingo license does not authorize a player to join a cash game from home through an app.
California’s 2026 online sweepstakes restriction
Section titled “California’s 2026 online sweepstakes restriction”The current official law book includes Penal Code §337o, which prohibits operating, conducting or offering the online sweepstakes games it defines in California.
Section 337o(c)(3) requires all of these conditions for its definition:
- The game is available online or accessible through a phone, computer terminal, or similar device.
- It uses a dual-currency system with the direct or indirect consideration described in the law.
- It simulates gambling. The listed examples include bingo, slots, table games, lotteries, and sports wagering.
- It awards cash or cash equivalents.
The October 2026 law book contains the enacted wording in §337o. Its definition of indirect consideration includes promotional currency provided through a free promotion or bonus, or with the purchase of a related product. A free entry route therefore does not, by itself, establish an exemption for a dual-currency bingo product that meets the definition.
Section 337o also restricts specified businesses from knowingly and willfully supporting the operation or promotion of these games. Subsection (f) preserves an exception for limited and occasional promotions incidental to substantial, genuine sales of consumer products or services, when they are not intended as a vehicle for ongoing gambling. It does not create a general exception for an ongoing sweepstakes casino. Subsection (e) preserves lawful games and methods of licensed gambling enterprises and the California State Lottery.
How to evaluate a cash bingo app
Section titled “How to evaluate a cash bingo app”First, read the terms to identify how a player enters and receives a prize. A score-based cash tournament, a dual-currency sweepstakes product, and a commercial online casino raise different legal questions.
For a skill tournament, examine how chance and decisions affect scoring, whether competitors face comparable conditions, and what the entry and prize rules say. The operator’s current California eligibility policy matters, but an app’s “skill” description is not a legal determination. Use the skill-app guide to check these disclosures.
For a sweepstakes app, compare its currency and prize model with §337o. Read the cash versus sweepstakes guide for the general model, then apply California’s specific rule. Social play without cash or cash-equivalent prizes needs to be distinguished from the prize model defined in that section.
A commercial online casino needs legal authority for its particular product and the player’s location. An app-store listing, an offshore license, or an accepted deposit does not establish California authorization. Check the operator’s identity and rules before providing money or documents; the guide to misleading bingo apps explains common warning signs.
Tribal bingo
Section titled “Tribal bingo”Tribal gaming has its own federal and tribal framework. The tribe, Indian lands, and game class matter, with compacts relevant to certain gaming activities. A tribal bingo venue’s authority does not extend automatically to an unrelated online app. The tribal and charity bingo guide explains these jurisdictions separately from local charitable licensing.
Questions players ask
Section titled “Questions players ask”Can I play a charity bingo game online in California?
Section titled “Can I play a charity bingo game online in California?”The charitable bingo framework described in §326.5 requires physical attendance at the authorized game location. It does not provide permission to join that game through an app from home.
Does California prohibit every sweepstakes promotion?
Section titled “Does California prohibit every sweepstakes promotion?”Section 337o defines the online prize games it prohibits and contains a limited exception for occasional promotions incidental to genuine consumer sales. Assess the actual promotion against those conditions; a broad claim that all sweepstakes are permitted or prohibited misses that detail.
Can children participate in charitable bingo?
Section titled “Can children participate in charitable bingo?”Penal Code §326.5(e) excludes minors. Check the applicable local requirements and the terms for any other gaming product rather than transferring a charity event’s age rule to a cash app.
